Jimmy Fallon Wants to Overturn Yuga Labs Subpoena

Jimmy Fallon has requested a court quash a subpoena issued by Ryder Ripps and Jeremy Cahen over a Yuga Lab lawsuit.

The Tonight Show star has petitioned the United States District Court Southern District of New York to quash a subpoena concerning the Yuga Labs vs. Ripps case.

According to the court filing, Fallon has no connection with either party and has never met or interacted with Ripps and Cahen. The lawyer explains that Fallon’s only contact with Yuga laws is that he acquired a Bored Ape Yacht Club non-fungible token (NFT) and mentioned it in two episodes.

Jimmy Fallon Does Not Want “Undue Burden

The filing reads, “Moreover, conducting an expedited search for the requested materials would unduly burden Mr. Fallon, particularly given that Ripps and Cahen can just as easily get the same documents from Yuga or other third parties, including its alleged agent, with respect to the BAYC NFTs.”

The lawyers petition the court to cancel the subpoena due to three reasons:

  1. The Subpoena seeks irrelevant documents.
  2. The Subpoena imposes an undue burden.
  3. The Subpoena is procedurally deficient.

In June 2022, Yuga Labs sued Ripps and Cahen for allegedly infringing its trademark, false advertising, and unfair competition. They created an NFT collection called Ryder Ripps Bored Ape Yacht Club (RR/BAYC).

In a separate case, Yuga Labs has been facing a class action lawsuit since December for allegedly conspiring with celebrities to promote its NFT collection. The suit has at least 37 co-defendants, including celebrities like Jimmy Fallon.

According to DappRadar, the volume of Bored Ape Yacht Club is down by more than 50%, and the average price was down by nearly 15% on Thursday.
