The Withdrawal of Class-Action Lawsuit

Bittrex and Poloniex are requesting the removal of Roche Freedman LLP from a particular class-action case brought against them. The class-action complaint was brought in 2020 by a boutique litigation firm focused on cryptocurrencies, alleging that a number of centralized exchanges had manipulated cryptocurrency prices using the tether, or USDT currency.

After Crypto Leaks released a number of videos, Kyle Roche, an attorney and founding partner of Roche Freedman, decided to withdraw from the lawsuits. Roche talks about his relationships with several cryptocurrency firms in the video segments. The lawyer alleges that various unsourced misleading comments and illegally obtained, excessively manipulated video snippets that lack appropriate context are featured in the clips. Roche chose to drop out of numerous prominent bitcoin litigation despite his defense.

A Legal Technique to Dismiss the Lawsuit

Elliot Greenfield of Debevoise & Plimpton LLP, representing Tether, asked for Roche’s whole firm to be excluded from the cases as soon as Roche withdrew himself from the proceedings. Now Poloniex and Bittrex are asking for the same thing because they think Roche’s words and moral character might impugn activities like the purpose of discovery.

The attorneys for the exchange wrote to the presiding judge of the Southern District of New York, saying that Mr. Roche’s recent remarks raise substantial questions about the motive underlying such discovery and how it would be used. The document also includes the exchange defendants recognizing that a protective order has been issued in this case and that lawyers are required to abide by such orders, but Mr. Roche’s remarks show that he has already misused sensitive information obtained via litigation.

The litigation company claims that it anticipated the defendants to use the issue against the whole legal practice, and Roche Freedman feels the accusations against Kyle Roche are demonstrably incorrect. Roche Freedman elaborated that it comes as no surprise that defendants are utilizing it as a legal technique to dismiss the whole company.
