August 22, 2022The New York Times reported that the federal government collected more than 300 documents with classified markings in total from Trump after he left office, including more than 100 classified documents in the initial boxes turned over to the National Archives in January, another batch investigators collected from Mar-A-Lago in June and the records seized in the FBI raid on August 8.

August 30, 2022The Justice Department said in a court motion that it collected evidence that Trump’s team “concealed and removed” documents from the secure storage room where investigators requested they remain, amounting to possible obstruction of its investigation—an allegation that could be the basis of potential charges against Trump, Bloomberg later reported, citing unnamed sources familiar with the probe.

January 9, 2023CBS News reported that Biden’s personal attorneys found approximately ten classified documents—some of which reportedly contained intelligence information on Ukraine, Iran and the United Kingdom—in his office at the Penn Biden Center on November 2, revelations confirmed by Biden’s special counsel, Richard Sauber, who said the records were turned over to the National Archives the following morning, Sauber said.

January 12, 2023Biden’s personal attorney Bob Bauer revealed at least 11 pages of classified documents, dating back to his tenures as vice president and a U.S. senator, were found at Biden’s Wilmington, Delaware, home between December and mid-January by Biden aides and Justice Department investigators.

The revelations surrounding the former presidents and vice presidents’ handling of classified documents has prompted both bipartisan calls for reform and GOP criticism of the Justice Department’s handling of the probe into Trump versus their investigation of Biden. The GOP-led House Judiciary Committee has opened its own inquiry into Biden’s handling of documents, but has said it will not explore the Trump case, citing the multiple other ongoing investigations into the former president’s conduct surrounding the documents and his role in the January 6 Capitol riot.

While Pence and Biden have said they are cooperating with the Justice Department in its investigations of their handling of classified documents, Trump has repeatedly claimed innocence, citing presidents’ ability to declassify documents. The U.S. Appeals Court for the Southern District of Florida, however, found that there is no evidence Trump took the proper steps to declassify the documents taken to Mar-A-Lago.

What We Don’t Know

How the classified documents probes will impact the 2024 presidential election. While Trump is the only one of the three who has formally entered the race, Pence and Biden have also said they are weighing plans to run. Politicos have speculated whether other GOP candidates are waiting to enter the race until the various legal probes against Trump conclude, speculating that any formal charges could hinder his campaign. In addition to the Justice Department’s probe into Trump’s handling of classified documents, it is investigating his role in the January 6 Capitol riot. Separately, the Manhattan District Attorney’s office has reportedly convened a grand jury that is weighing charges against Trump in connection with payments made to adult film star Stormy Daniels during the 2016 presidential campaign in exchange for her silence about their alleged affair. A Georgia Grand Jury also recently concluded its review of Trump’s efforts to overturn the results of the 2020 presidential election in the state, and a forewoman said publicly this week that it recommended criminal charges against multiple people, though it’s unclear if Trump is among them.
