Do Kwon, the founder of Terraform Labs, has filed an appeal against the extradition decision of the High Court of Podgorica, the capital of Montenegro, according to reports.
According to the Montenegrin Court of Appeal, Kwon submitted an appeal to the court on December 6, expressing his refusal to accept the court’s decision, stating, “I do not accept the court’s decision to extradite me, so I do not submit to the court’s decision.”
Kwon’s appeal triggers a compulsory reconsideration of the extradition ruling, as per local media reports. “Since Kwon Do-hyung appealed, the Montenegrin Court of Appeals must reexamine the decision to extradite him.”
Recently, a Montenegro court approved Kwon’s extradition to either South Korea or the United States, citing that the legal prerequisites for the extradition were met. According to the court’s announcement, Kwon has given consent to be extradited to South Korea.
Nevertheless, the Terraform Labs founder’s case involves extradition requests from multiple states. The statement appointed the Minister of Justice of Montenegro as the decision maker on which state takes priority in the event of an extradition.
On June 15, the Montenegrin court decided to detain Kwon for six months until December 15 for extradition. Reports mentioned that Kwon’s appeal came approximately two weeks after the decision to extradite him, which was announced on November 24.
Marija Rakovic, press officer of the Podgorica High Court, stated, “The subject of an extradition case like Kwon Do-hyung has the right to object to the court decision.” Moreover, the press officer explained that once the appeal is submitted, the Montenegro Court of Appeals will decide on the extradition once more.
