Montenegro High Court Reverses Do Kwon’s Extradition Decision to U.S

A further triumph in the extradition case to the U.S has been achieved by Terra co-founder Do Kwon. An official translation of Tuesday’s announcement states that the highest court in Montenegro reversed a lower court’s decision to extradite Do Kwon to the United States.

Do Kwon has now won three cases against the Montenegro High Court, which had before supported the extradition requests of South Korea and the U.S.

Ongoing Drama

In a verdict issued after the panel hearing on March 5, 2024, the Appellate Court of Montenegro approved the defense counsel’ request and reversed the extradition decision of defendant Kwon Do Hyeong.

The Court of Appeals has not cited “significant violations of the provisions of criminal procedure” in the legal action that led to the extradition judgment in February. The most important details of the arrival order request letter are not supported by “clear and valid reasons,” as stated in the statement.

Moreover, a higher court in Montenegro had already authorized Do Kwon’s extradition. After being found guilty of illegally fabricating passports, Do Kwon and Han Chang-joon were sentenced to four months in jail. The subsequent step was the extradition of Han Chang-Joon to South Korea.

But there was some good news for Kwon: in December, the Montenegrin High Court awarded him a second victory in his fight against extradition after ruling that Do Kwon’s petitions were still pending.

Additionally, Do Kwon and his firm are engaged in a strategic legal battle with the U.S SEC in the Southern District of New York, in an effort to get the SEC’s case against them dismissed. Notably, the key objective is to disprove the testimony of SEC expert witness Dr. Matthew Edman.
