Former President Donald Trump is arguing the federal trial linked to his efforts to overturn the 2020 election should be delayed until April 2026—a date more than three years past Special Counsel Jack Smith’s proposed trial day.
Trump’s attorneys said in a Thursday filing that the government is attempting to “deny” the former president’s ability to prepare for a trial.
Attorneys further argued that the trial should be delayed due to the vastness of the discovery process and complexity of the legal issues at hand, citing the 8.5 terabytes’ worth of materials included in discovery .
The April 2026 proposal clashes with Smith, who led the January 6 probe into Trump and proposed a start date of Jan. 2, 2024, just last week.
U.S. District Judge Tonya Chutkan, who will preside over the trial, is expected to finalize a date on August 28.
