Harvey Weinstein—Serving 39 Years In Prison—Won’t Face Another Sexual Assault Trial In L.A.

Disgraced film magnate Harvey Weinstein will not face a new trial over three sexual assault charges a Los Angeles jury deadlocked on in December, prosecutors said Tuesday according to multiple reports, as the 70-year old is serving a 23-year sentence in New York and was recently sentenced to an additional 16 years on other sexual misconduct charges in Los Angeles.

Deputy District Attorney Paul Thompson at a hearing made the decision known to Superior Court Judge Lisa B. Lench, who then dismissed the charges, according to the Associated Press.

The unresolved charges were related to claims from two accusers, Lauren Young (Jane Doe No. 2) and Jennifer Siebel Newsom (Jane Doe No. 3), the wife of California Gov. Gavin Newsom.

Weinstein was found guilty in December on one count of rape and two counts of sexual assault relating to Jane Doe No. 1, who has since identified herself as Evgeniya Chernyshoval; he was found not guilty on one count of sexual battery relating to Jane Doe No. 3.

Lench said Weinstein would be returned to New York from Los Angeles, according to the AP.

“Even though the defendant has been convicted of New York and L.A. for crimes against other women, I wanted him to be held accountable for what he did to me,” Young said during Tuesday’s hearing, according to Variety. Thompson said in court that if found guilty of the charge related to Young, Wenstein would likely only be sentenced to only one additional year. In a written statement that was read in court, Siebel Newsom said, “he tried to ruin my life and the lives of so many other women. … He deserves to spend the rest of his life in prison.”

In 2020 he was sentenced to 23 years in New York, where he was found guilty of one count of a criminal sexual act in the first degree and one count of rape in the third degree, but acquitted of predatory sexual assault and rape in the first degree. He will serve his time in Los Angeles after his sentence in New York concludes. He is likely to spend the rest of his life in prison—though he has appealed his New York conviction, and is expected to do the same in Los Angeles.
