Former White House Lawyer Tells CNN Donald Trump Likely To Spend Time In Jail For Violating Gag Order

Former White House lawyer Ty Cobb told CNN’s Erin Burnett Monday night that he believes Donald Trump will “spend a night or a weekend in jail” for violating U.S. District Judge Tanya Chutkan’s gag order. “I think it’s going to take that,” Cobb said on CNN’s Erin Burnett OutFront. “I think it’ll take that to stop him.”

Judge Chutkan—overseeing Trump’s federal case resulting from efforts to overturn the 2020 presidential election—issued the gag order earlier this month and reinstated it with a court ruling Saturday. The order bars Trump from making comments targeting court personnel, potential witnesses or attorneys.

“As the court has explained, the First Amendment rights of participants in criminal proceedings must yield, when necessary, to the orderly administration of justice—a principle reflected in Supreme Court precedent, the Federal Rules of Criminal Procedure, and the Local Criminal Rules,” Judge Chutkan wrote. “And contrary to Defendant’s argument, the right to a fair trial is not his alone, but belongs also to the government and the public.”

The former president has taken to social media to attack Special Counsel Jack Smith, who is prosecuting the case, and Judge Chutkan. “The Obama-appointed federal judge in D.C., a TRUE TRUMP HATER, is incapable of giving me a fair trial,” Trump said in a post to his Truth Social platform Monday. “Her hatred of President DONALD J. TRUMP is so great that she has been diagnosed with a major, and incurable, case of TRUMP DERANGEMENT SYNDROME!”

Cobb told Burnett that compared to the fines issued against Trump by a New York judge for violating a gag order in the New York case, the former president’s public statements in the federal case could lead to far more significant penalties. “That’s in a civil case,” Cobb said. “That’s not as consequential as Judge Chutkan’s case. I think she’ll come in with a much heavier penalty, and ultimately, I think he’ll spend a night or a weekend in jail.”

“Wow,” Burnett responded. “That’ll be an incredible thing to actually see happen.”
