REX Shares has filed an effective prospectus to launch Ethereum (ETH) and Solana (SOL) staking exchange-traded funds (ETFs) in the United States, according to Bloomberg ETF analyst James Seyffart.
The filing, dated May 30, confirms that the ETFs—named REX-OSPREY™ ETH + STAKING ETF and REX-OSPREY™ SOL + STAKING ETF—will be structured under the 1940 Act, enabling them to sidestep the more rigorous 19b-4 process required for spot crypto ETFs.
The new products are designed to provide staking exposure for ETH and SOL without the need for investors to manage wallets or self-custody. Both funds are set to list on NASDAQ under the tickers ISK (Ethereum) and SSK (Solana).
Seyffart highlighted that the ETFs will gain spot exposure through Cayman Islands-based subsidiaries—one of several “clever legal and regulatory workarounds” used to fast-track these products to market. This method allows them to gain staking yields while navigating current U.S. regulatory constraints.
“These are 40-act funds with a unique structure and do not go through the 19b-4 process,” Seyffart noted, adding that this could allow a market debut “within the next few weeks.”
However, he cautioned that while this approach offers speed, it may not be the most efficient in the long term. Seyffart explained that grantor trusts—used by existing spot Bitcoin and Ethereum ETFs—may eventually be permitted to support staking as well, pending guidance from the IRS. That evolution could introduce more optimized vehicles later this year or beyond.
“This is a play to get something to market first,” Seyffart said, underlining the urgency of being first-movers in a fast-evolving ETF space.
Though the SEC and CFTC have not approved or endorsed the prospectus’s contents, the filing signals a growing push toward regulated staking products in U.S. markets—especially as institutional appetite for crypto-based yield products grows.
