- Commodity Futures Trading Commission (CFTC) commissioner Caroline Pham gave an interview to Bloomberg on January 17.
- Commissioner Pham met with many international regulators to talk about the implementation of crypto standards all over the world.
“I have been going out there and discussing with the international policymakers on different types of standards can we have at the global pace and the way to close the gaps. I had more than 75 meetings and there is a very newfangled discussion happening outside the boundaries of the United States about the same.”
It is not very clear whether every meeting included lawmakers in separate jurisdictions or if the meetings were replicated in that very jurisdiction.
When the media asked questions regarding recent events in the crypto space, particularly the in-progress dispute between Genesis and Gemini, Pham explained that the problem is a concern. According to her, all the regulators should utilize their authority to clarify what comprises a crypto financial instrument and crypto non-financial activity. She explained that suitable regulatory and legal structures should be applied.
Pham accepted that the CFTC has regulatory authority that it can utilize and that she would love the CFTC to “not only be satisfied with nurturing the status quo” but give much direction to crypto firms this year.
Pham also explained her efforts toward permitting the CFTC to manage digital assets. Pham highlighted that she sponsors the Global Markets Advisory Committee, both of which partially deal with crypto law.
The commissioner has commented on high-profile crypto cases. On January 10, she made a statement on CFTC charges against Mango Markets attacker Avraham Eisenberg. She highlighted that products on digital asset exchanges can be acknowledged as derivatives and come under the jurisdiction of the CFTC.
On December 21, 2022, she made a statement on the CFTC’s charges against FTX partners Caroline Ellison and Gary Wang soon after the SDNY publicized its own charges. She referred to those advancements as a significant move for justice for those who were affected by FTX’s collapse.
