Hinman Attorney-Client Privilege Claims to be Heard on June 7th.

The SEC vs. Ripple case update

Defense counsel James Filan said this morning that a conference would be held on Tuesday, 

June 7, 2022, to consider the SEC’s claims of attorney-client privilege over the 2018 Hinman speech papers. The next court date in the SEC v Ripple lawsuit is today. 

According to a letter from Judge Sarah Netburn, the SEC and Ripple Lab legal teams are scheduled to present in person.

Where it all started

On May 18, the SEC responded to a Ripple response to an SEC brief asserting that William Hinman’s speech-related materials are protected by the attorney-client privilege.

The SEC’s and Ripple Labs’ defense teams are focusing on William Hinman and a 2018 speech.

In August 2021, Ripple Labs filed a motion to proceed. Since then, Ripple defense counsel Matthew Solomon has objected to the SEC brief, citing the SEC’s filing of at least six applications to force Ripple to testify.

Bitcoin (BTC) and Ethereum (ETH) are not securities, according to Hinman.

Following the SEC’s May 18 response to a Ripple Lab statement on May 13, the courts stayed mute until Tuesday.

Judge Netburn did not provide any dial-in information for the June 7 conference. 

With the courts having previously found in Ripple Lab’s favor twice, any further finding in Ripple Lab’s favor will very certainly result in further SEC efforts to overturn the court’s decision. 

However, XRP sensitivity to developments from the June 7 summit is likely to be high.

To reach the First Major Resistance Level at $0.4340, XRP must break through the $0.4201 pivot. To break clear of Tuesday’s high of $0.4329, XRP would require support from the whole crypto market.
