Federal Appeals Court Pauses Trade Court’s Ruling Against Trump Tariffs

The Trump administration has breathing room after a Federal Appeals Court paused a ruling against the Trump tariffs. Going forward, the Trump administration maintains that it will still file an appeal against the US Court of International Trade ruling, but time may be running out.

Federal Appeals Court Provides A Lifeline For Trump Tariffs

The US Court of Appeals for the Federal Circuit has released an order effectively pausing a ruling by the US Court of International Trade. According to a Bloomberg report, the Federal Circuit has granted a stay on the decision, providing a lifeline for Trump tariffs.

The filing by the Justice Department poked holes in the Trade Court’s decision to strike down Trump tariffs. The Justice Department argued that the ruling from the US Court of International Trade infringed on Donald Trump’s rights to steer foreign policy.

The Federal Circuit leaned toward the argument of the Justice Department to grant an order of a stay. However, the court did not specify the length of the order, but a briefing schedule ends on June 9.

Previously, White House Adviser Kevin Hassett hinted that the Appeal Court will overturn the Trade Court’s decision. Hassett disclosed that the Trump administration is willing to pursue redress all the way to the Supreme Court.

Opposition Mounts Against Trump’s Trade War

As the Trump tariffs intensify, dissent against the US President’s handling of bilateral trade agreements is growing. The US Trade Court fired the first salvo at the Trump administration, noting that the tariffs are an overstep beyond the President’s powers.

Hours after the Trade Court’s decision, a federal judge in Washington declared several Trump tariffs illegal. However, the judge delayed his order by 14 days, allowing the Justice Department to file an appeal.

Despite the mounting opposition, the Trump administration is maintaining a bullish outlook. With the option of appeals and a labyrinth of legal loopholes at its disposal, the administration is doubling down on its reciprocal tariff strategy.
